Apple’s appeal to the High Court has failed today, meaning that the Galaxy Tab 10.1 tablet – long sought after by many – will now be officially sold in Australia just in time for the Christmas shopping season.
This will mean that Samsung’s tablet could be on sale by Monday – and the company has already announced its pricing. The tablet will be sold for $579 for the 16GB Wi-Fi-only version; and $729 that comes with both 3G and Wi-Fi.
“Samsung Electronics Australia is pleased with today’s judgment by the High Court of Australia to deny Apple’s request to appeal the decision of the Full Court,” the company said about the statement. “The Full Court of Australia decision on November 30 clearly affirmed our view that Apple’s claims lack merit and that an injunction should not have been imposed on the GALAXY Tab 10.1.”
Both companies are at loggerheads in a patent war, with Apple and Samsung engaged in lawsuits around the world. Coupled with the news that the tablet will not be banned in the United States, Samsung is getting a very early Christmas present.
The court also decided that Apple should pay Samsung’s legal fees.
